This Privacy Policy ("Policy") describes how BEON and its parent company, affiliates, subsidiaries, officers, directors, employees, agents, and representatives (collectively, "BEON," "Company," "we," "us," or "our") collect, use, store, share, and protect your personal information when you access or use the BEON mobile application, website, and all related services (collectively, the "Service").

By downloading, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree with any part of this Policy, you must immediately discontinue use of the Service.

This Policy applies to all users of the Service worldwide. If you are located in the European Economic Area ("EEA"), United Kingdom ("UK"), or other jurisdictions with specific data protection laws, additional provisions in Section 14 apply to you.

2.1 Information You Provide Directly

    When you create an account, use features, or communicate with us, we may collect:

  • User-Generated Content: Photographs, videos, stories, feed posts, event descriptions, comments, ratings, reviews, poll responses, and any other content you create, upload, or share through the Service.
  • Communications: Messages sent through in-app chat, reports, feedback, support requests, and any other communications you send to us or to other users through the Service.
  • Event and Activity Data: Events you create, attend, or express interest in, including venue details, dates, times, guest lists, and your participation history.
  • Transaction Information: If applicable, information related to tickets, points redemptions, or any future payment features.
  • Survey and Research Data: Responses to surveys, questionnaires, or research studies you voluntarily participate in.

2.2 Information Collected Automatically

    When you access or use the Service, we automatically collect:

  • Location Data: With your explicit permission, we collect precise geolocation data from your device's GPS, Wi-Fi, Bluetooth, and cellular signals. This is essential for the core functionality of the Service, including showing nearby events and users. Your location is generalized (rounded to approximately 100 meters) before being displayed to other users.
  • Device Information: Device type, model, manufacturer, operating system and version, unique device identifiers, mobile network information, screen resolution, and language settings.
  • Usage Data: Features used, pages viewed, actions taken, time and date of access, time spent on pages, interaction patterns, search queries, and navigation paths.
  • Log Data: IP address, browser type, referring/exit pages, crash reports, and system activity logs.
  • Performance Data: App load times, errors, response times, and technical diagnostics.

2.3 Information from Third Parties

    We may receive information about you from:

  • Authentication Providers: Google and Apple provide us with your name, email address, and unique account identifier when you choose to sign in using their services.
  • Other Users: When other users interact with you, mention you, invite you to events, or report your activity.
  • Service Providers: Analytics providers and infrastructure partners may provide aggregated or technical data.

2.4 Cookies and Similar Technologies

    Our website and Service may use cookies, pixels, local storage, and similar technologies to recognize you, remember your preferences, understand usage patterns, and improve the Service. You can manage cookie preferences through your browser or device settings.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Providing the Service: Creating and managing your account, displaying your profile to other users, enabling event creation and discovery, facilitating in-app messaging, and delivering core features.
  • Location-Based Features: Showing you events and users near your location, displaying your general area on the map (with your permission), and providing distance-based search and recommendations.
  • Personalization: Tailoring content, recommendations, and event suggestions to your interests, location, and activity history.
  • Communication: Sending you notifications about events, messages, connection requests, and important account updates. Responding to your support inquiries and feedback.
  • Safety and Security: Detecting, investigating, and preventing fraud, abuse, harassment, security incidents, and violations of our Terms and Conditions. Verifying accounts and enforcing our policies.
  • Analytics and Improvement: Understanding how users interact with the Service, identifying trends and issues, measuring feature performance, and improving the overall user experience.
  • Legal Compliance: Fulfilling legal obligations, responding to lawful requests from authorities, establishing or defending legal claims, and protecting our rights and the rights of others.
  • Points and Rewards: Tracking your engagement, awarding points, maintaining leaderboards, and managing achievement and reward systems.
  • Moderation: Reviewing user-generated content and reports to maintain community standards and a safe environment.

4. Legal Basis for Processing (EEA/UK Users)

If you are in the EEA or UK, we process your personal data on the following legal bases:

  • Contract Performance: Processing necessary to provide you with the Service as agreed in our Terms and Conditions.
  • Legitimate Interests: Processing necessary for our legitimate business interests, including fraud prevention, security, analytics, and improving the Service, provided these interests are not overridden by your fundamental rights.

5.1 With Other Users

    By using the Service, certain information is visible to other users:

  • Your profile name, photos, bio, interests, and age.
  • Your approximate location (generalized to approximately 100 meters) when location sharing is enabled.
  • Events you host or attend (unless marked private).
  • Feed posts, stories, comments, and other public content.
  • Your points, level, and leaderboard rank.
  • Your email address, phone number, exact GPS coordinates, and other sensitive account details are never displayed to other users.

5.2 With Service Providers

    We share information with trusted third-party service providers who assist us in operating the Service, including:

  • Cloud Infrastructure: Amazon Web Services (AWS) for hosting, storage, and computing.
  • Authentication: Google and Apple for account sign-in verification.
  • Maps and Location: Google Maps Platform for map display and location services.
  • Analytics: Aggregated, anonymized usage data with analytics providers.
  • Communication: Email service providers for transactional notifications.
  • All service providers are contractually bound to use your information only for the purposes we specify and in accordance with this Policy.

5.3 For Legal and Safety Reasons

    We may disclose your information if we believe in good faith that such disclosure is necessary to: comply with applicable law, regulation, legal process, or enforceable governmental request; enforce our Terms and Conditions and investigate potential violations; detect, prevent, or address fraud, security, or technical issues; or protect against harm to the rights, property, or safety of BEON, our users, or the public as required or permitted by law.

5.4 Business Transfers

    In the event of a merger, acquisition, reorganization, bankruptcy, asset sale, or similar transaction, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on the Service before your information becomes subject to a different privacy policy.

5.5 With Your Consent

    We may share your information in other circumstances with your explicit consent.

5.6 What We Never Do

    We do NOT sell your personal information to third parties.

    We do NOT share your personal information with advertisers for targeted advertising.

    We do NOT provide your private messages to any third party except as required by law.

6. Data Storage and Security

6.1 Storage

    Your data is stored on secure servers provided by Amazon Web Services (AWS) located in India (Mumbai region). Data may be transferred to and processed in other countries where our service providers operate, subject to appropriate data protection safeguards.

6.2 Security Measures

    We implement industry-standard technical and organizational measures to protect your information, including:

  • Encryption of data in transit (HTTPS/TLS) and at rest (AES-256).
  • Secure authentication with JSON Web Tokens and multi-factor verification.
  • Automated threat detection and intrusion prevention systems.
  • Web Application Firewall (WAF) protection against common attacks.
  • Access controls limiting employee access to personal data on a need-to-know basis.
  • Regular security audits and vulnerability assessments.
  • Automated backup systems with deletion protection.
  • Audit logging of all system access.

6.3 Security Limitations

    While we strive to protect your personal information, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee absolute security. You acknowledge and accept the inherent risks of providing information online and will not hold us responsible for any breach of security unless it is due to our gross negligence.

7. Data Retention

We retain your personal information for as long as: your account remains active; it is necessary to provide you with the Service; we have a legitimate business need (such as fraud prevention and safety); or we are required to retain it by applicable law.

When you delete your account, we permanently delete your personal data from our active systems within 30 days, including your profile, messages, posts, events, points, and all associated content across all database tables. Certain information may be retained in encrypted backups for up to 14 days after deletion and in anonymized, aggregated form for analytics purposes. Information required to be retained by law (such as transaction records or abuse reports) will be kept for the legally mandated period.

8. Your Rights and Choices

8.1 All Users

    Regardless of your location, you have the right to:

  • Access: Request a copy of all personal data we hold about you. You can do this through the app's account settings.
  • Correction: Update or correct your profile information at any time through the app.
  • Deletion: Delete your account and all associated data through the app's account settings. This action is permanent and irreversible.
  • Location Control: Enable or disable location sharing at any time through your device settings or the app's privacy settings.
  • Notification Preferences: Manage which notifications you receive in the app's settings.
  • Withdraw Consent: Where processing is based on consent, you may withdraw consent at any time.

8.2 EEA/UK Residents (GDPR)

    In addition to the above, you have the right to:

  • Restriction: Request that we restrict the processing of your personal data in certain circumstances.
  • Portability: Receive your personal data in a structured, commonly used, machine-readable format (JSON).
  • Objection: Object to processing of your personal data based on legitimate interests.
  • Automated Decision-Making: Not be subject to decisions based solely on automated processing, including profiling, that produce legal effects concerning you.
  • Lodge a Complaint: File a complaint with your local data protection authority.

8.3 California Residents (CCPA/CPRA)

    If you are a California resident, you have the right to:

  • Know what personal information we collect, use, and disclose.
  • Request deletion of your personal information.
  • Opt-out of the sale of personal information (we do not sell personal information).
  • Non-discrimination for exercising your privacy rights.

9. Location Data

BEON is a location-based social platform. Location data is central to the Service:

  • Collection: We collect precise location data only when you grant permission through your device's location services.
  • Generalization: Your exact location is never shared with other users. We round coordinates to approximately 100 meters before displaying your general area.
  • Incognito Mode: You can enable Incognito Mode to hide your location from all other users while still using the Service.
  • Control: You can revoke location permission at any time through your device settings. Some features may be limited without location access.
  • Background Location: We do not collect location data when the app is closed or in the background unless you have explicitly enabled this feature.

10. Children's Privacy

The Service is strictly intended for users aged 18 years and older. We do not knowingly collect, solicit, or maintain personal information from anyone under 18 years of age. If we become aware that we have collected personal information from a person under 18, we will delete that information immediately. 11. Third-Party Services and Links

We are not responsible for the privacy practices, content, or security of any third-party services. We encourage you to review their privacy policies before providing them with your information.

The Service may contain links to or integrations with third-party websites, services, or applications, including:

  • Google (Sign-In, Maps): Subject to Google's Privacy Policy (policies.google.com/privacy).
  • Apple (Sign-In): Subject to Apple's Privacy Policy (apple.com/privacy).
  • Amazon Web Services: Subject to AWS's Privacy Policy (aws.amazon.com/privacy).

12. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including India and other countries where our service providers operate. These countries may have data protection laws that differ from your jurisdiction. Where required, we ensure appropriate safeguards are in place, including Standard Contractual Clauses approved by the European Commission or equivalent mechanisms.

13. Do Not Track Signals

Some browsers offer a "Do Not Track" (DNT) setting. There is currently no industry standard for recognizing or honoring DNT signals, and the Service does not currently respond to DNT signals.

14. Changes to This Privacy Policy

Your continued use of the Service after such changes constitutes your acceptance of the updated Policy. We encourage you to review this Policy periodically.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. If we make material changes, we will notify you by:

  • Posting the updated Policy on our website and in the app.
  • Updating the "Last Updated" date at the top.
  • Sending a push notification or email for significant changes.

16. Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, without regard to conflict of law principles. For EEA/UK residents, applicable local data protection laws (including the GDPR) shall also apply to the extent they provide greater protection.
